Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE OR PLACING AN ORDER. BY ACCESSING OR USING DUKAANTOTABLE.COM, YOU AGREE TO BE BOUND BY THESE TERMS.

1. Who We Are
DukaanToTable.com (the "Site") is operated by Dukaan LLC, a New York limited liability company and subsidiary of Fontainhas Holdings LLC ("Dukaan," "we," "us," or "our"). Our principal place of business is in New York, New York.

2. Acceptance of Terms
By accessing or using the Site, creating an account, or placing an order, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, do not use the Site.

3. Accounts and Eligibility
To place orders or subscribe to our Discovery Box, you must create an account. You agree to:
Provide accurate, current, and complete information during registration
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activity that occurs under your account

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

4. Orders and Pricing

4.1 Order Acceptance
All orders are subject to availability and acceptance by Dukaan. We reserve the right to refuse or cancel any order at any time, including after a confirmation email has been sent, in cases of pricing errors, product unavailability, or suspected fraud.

4.2 Pricing and Currency
All prices listed on the Site are in United States Dollars (USD). The monthly Discovery Box subscription is priced at $65 per month. Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

If you place an order using a non-US bank account or a card issued outside the United States, your bank or card issuer may apply foreign transaction fees or currency conversion charges. These fees are entirely the responsibility of the customer and are not controlled by or refundable from Dukaan.

4.3 Taxes
Applicable sales tax will be calculated and added to your order at checkout based on your shipping address.

5. Subscription Discovery Box

5.1 How Subscriptions Work
Dukaan offers a single monthly Discovery Box subscription priced at $65 per month. Each box is curated entirely by us around a rotating monthly theme — which may include chai, coffee, pantry staples, snacks, or self-care goods, and may cross over between categories. There are no box selections or customizations available; by subscribing, you trust us to curate for you. Subscriptions automatically renew on a recurring monthly basis. By subscribing, you authorize Dukaan to charge your payment method each month until you cancel. You will receive a pre-shipment notification email at least 7 days before each box ships and your card is charged.

5.2 Cancellation
You may cancel your subscription at any time through your account portal or by contacting us at legal@dukaantotable.com. To avoid being charged for the next shipment, cancellation must be completed at least 7 days before your next scheduled ship date. Cancellations received after that window will take effect for the following billing cycle.

5.3 Pausing Your Subscription
You may pause your subscription at any time through your account. You may not pause for two consecutive months. Paused subscriptions will automatically resume after 6 months. If you wish to extend your pause, you must re-initiate it before the 6-month period expires.

5.4 Billing
Your payment method will be charged at the time your box is processed for shipment. Failed payments may result in suspension of your subscription until payment is resolved. You are responsible for keeping your payment information current.

6. Shipping

6.1 Free Shipping Threshold
Orders over $65 qualify for free standard shipping within the contiguous United States. Orders at or under $65 will be charged a shipping fee calculated at checkout based on your address. We do not currently ship outside the United States.

6.2 Delivery Estimates
Delivery estimates are provided in good faith and are not guaranteed. Dukaan is not responsible for delays caused by the carrier, weather, customs, or other circumstances outside our control.

6.3 Shipping Protection (Optional)
At checkout, you will have the option to purchase shipping protection for your order. Shipping protection covers lost, stolen, or significantly damaged packages as determined by the applicable terms of the protection plan. If you elect to purchase shipping protection and your package is lost, stolen, or arrives damaged, you may file a claim directly through the protection provider.

If you do not purchase shipping protection, the limitations in Section 6.4 below apply.

6.4 Lost, Stolen, or Undelivered Packages
Once a package is marked "Delivered" by the carrier, Dukaan's liability for that shipment is fulfilled. We understand that "delivered but not received" situations do occur, and we want to help.

If your package is marked delivered but you have not received it, please contact us at hello@dukaantotable.com within 5 business days of the marked delivery date. We will:
File a claim with the carrier on your behalf (as the shipper of record, we are the party with standing to initiate carrier claims)
Provide you with updates on the status of that claim
If the claim is approved and the carrier reimburses Dukaan, we will issue you either a full refund or a replacement box at our discretion

Please note: carriers do not guarantee reimbursement. In cases where a carrier denies a claim and shipping protection was not purchased, Dukaan cannot guarantee a refund or replacement. We strongly encourage customers who are concerned about porch theft or delivery safety to consider purchasing shipping protection at checkout.

6.5 Damaged Packages
If your order arrives damaged, please contact us within 5 business days of delivery with photos of the damage. We will work with you to assess the situation and, where appropriate, file a claim with the carrier or arrange a replacement.

7. Returns and Refunds

7.1 Subscription Boxes
All subscription Discovery Boxes are final sale. Due to the curated and perishable nature of our boxes, we do not accept returns or offer refunds on subscription box orders, except as described in Section 6 above regarding carrier claims.

7.2 Individual Store Items
For individual (non-subscription) store purchases, eligible items may be returned for store credit only within 14 days of delivery, provided the item is unopened, unused, and in its original packaging. Perishable, consumable, and personal care items are not eligible for return.

To initiate a return, contact hello@dukaantotable.com. Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product.

7.3 Incorrect or Defective Items
If you receive an incorrect or defective item, please contact us within 5 business days of delivery. We will arrange a replacement or issue a refund at our discretion.

8. Food and Product Safety
Dukaan sells products from a variety of third-party boutique brands and producers. While we curate our selection carefully, we are not the manufacturer of most products sold on this Site. Product descriptions, ingredient lists, and allergen information are provided by the applicable manufacturer and are subject to change.

Customers with food allergies, dietary restrictions, or medical conditions should review all product labels carefully before consuming. Dukaan is not liable for adverse reactions to products sold on the Site.

9. Intellectual Property
You may not reproduce, distribute, modify, transmit, display, publish, or otherwise use any content from this Site without our prior written permission, except for personal, non-commercial use. The Dukaan to Table name, /du.kaan/ logotype, and associated brand marks are trademarks of Dukaan LLC. Unauthorized use is prohibited.

Third-party product names, brands, and trademarks appearing on this Site are the property of their respective owners.

10. User Conduct
By using this Site, you agree not to:
Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorized access to any portion of the Site or its related systems
Transmit any harmful, offensive, or disruptive content
Use automated tools to scrape, crawl, or extract data from the Site without our written consent
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Interfere with the proper functioning of the Site

We reserve the right to terminate access for any user who violates these Terms.

11. Third-Party Links and Content
The Site may contain links to third-party websites or reference third-party products and services. These links are provided for convenience only. We do not endorse, control, or assume responsibility for any third-party websites, content, or practices. Your use of any third-party site is at your own risk and subject to that site's terms and conditions.

12. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE AND PURCHASE OF PRODUCTS IS AT YOUR SOLE RISK.

13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DUKAAN LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM.

14. Dispute Resolution and Arbitration

14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws provisions.

14.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Arbitration will be conducted in New York, New York, or via videoconference at either party's request. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver
YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN DUKAAN AND YOU INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW, (i) NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER; (ii) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED OR RESOLVED ON A CLASS-ACTION BASIS; AND (iii) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.

15. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site following the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
